I was needing help for a friend who’s trying to collect and claim a tax overage . I know it should be straight forward but I’ll do my best to try and explain where we need help preferably from an attorney?

This all started in 2017 he was incarcerated when his mother started going downhill quickly (dead 3 months later) from brain cancer, her sister (his aunt ) flew in and took advantage of this and filed a quit qlaim deed with the county and in mean time didn’t know there was a will filed with the county shortly after revealing the home was to be left to her son only (my friend) well he never did anything about transferring, (didn’t know any better, and recently lost it (or she did rather) for back taxes .

This isn’t the brightest family , so anyway the house being free and clear sold leaving an overage of 90k after the final tax bill was 17k g , house brought 107 k minus the 17 equals 90k is what I mean . So my question is how to get the county to acknowledge the will that was filed right after the death to be able to honor her wishes and recognize that her son is the one that should have claim to the tax overages instead of the greedy aunt who took advantage with the quit claim deed at the last minute with the mother who was not of sound mind and body ?

We would certainly suggest having a licensed real estate attorney in Florida view this situation

It would appear the person who received the quit claim deed can claim the funds so perhaps an attorney can dispute the quit claim deed due to the owner as the prior owner was not mentally well

Emailing each county treasury website or county tax collector website is very effective getting tax sale overage lists

A really good way to obtain lists is to copy and use the email template we have in the resources section of your member area. Just click on the "Resources" link on the right hand side after you log in.  Once in, you would then go and click on the Download documents section. You will then see "Email Request for Overages List Rev. 6". You can copy this template and email to all the county treasurer sites. You will then be able to get some lists.
